The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, March 7, 2006 with Honorable Mayor Gary R. Johnson. presiding and the following named Councilmembers present: Claude Jinks, Frank McGuffin, William Rooney, Kay Senter, Rick Trent and Mel Tucker.
Councilmember Jinks made a motion to approve the February 21, 2006 minutes as circulated; Councilmember Rooney seconded the motion and all voted 'aye'.
A public hearing was held on the following Resolution No. 02-06. Councilmember Jinks made a motion to adopt said Resolution. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.
RESOLUTION NO. 02-06
PLAN OF SERVICES
A RESOLUTION ADOPTING A PLAN OF SERVICES FOR THE ANNEXATION OF PROPERTY LOCATED ON SPOUT SPRINGS ROAD, 55-ACRE LAKESIDE PORTION ADJACENT TO THE WINDSWEPT DEVELOPMENT.
WHEREAS, TENNESSEE CODE ANNOTATED, TITLE 6, CHAPTER 51, AS AMENDED REQUIRES THAT A PLAN OF SERVICES BE ADOPTED BY THE GOVERNING BODY.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF MAYOR AND COUNCIL OF THE CITY OF MORRISTOWN, TENNESSEE:
Beginning at the point of intersection of Parcel 47.00 and 47.01 of Map 16 on the Hamblen County Tax Map and the southern edge of the right-of-way of Boatman Ridge Road, Thus in a south westerly direction along the common boundary of Parcel 47.00 of Hamblen County Tax Map 16 and the southern edge of the Boatman’s ridge road right-of-way to the intersection of said right-of-way and parcels 47.00 and 48.00 of Hamblen County Tax Map 16; Thence in a north easterly direction along the common boundary shared by parcel 47.00 and 48.00 of Hamblen County Tax Map 16, thence continuing to follow the common boundary shared by parcels 47.00 and 48.00 of Hamblen County Tax Map 16 to a point of intersection of parcels 45.00, 47.00, and 48.00 of Hamblen County Tax Map 16; Thence in a south westerly direction following the common boundary line shared by Parcels 45.00 and 47.00 of Hamblen County Tax Map 16 to a point of intersection of Parcels 47.01, 47.00 and 45.00 of Hamblen County Tax Map 16, Thence in a southerly direction following the common boundary shared by parcels 47.00 and 47.01 to the point of beginning.
Section I. Pursuant to the provisions of Title 6, Chapter 51, Tennessee Code Annotated, there is hereby adopted, for the area bounded as described above, the following plan of services.
a. Police
1. Patrolling, radio responses to calls, and other routine police services, using present personnel and equipment, will be provided upon the effective date of annexation.
2. Traffic signals, traffic signs, street markings and other traffic control devices will be installed as the need therefore is established by appropriate study and traffic standards.
b. Fire
Fire protection by the present personnel and the equipment of the fire fighting force, within the limitations of available water and distances from fire stations, will be provided upon the effective date of annexation.
c. Water
1. Water for potable use will be provided in accordance with current policies of the Morristown Utility Commission unless located in an area in which another utility district has made service available and asserts Title 7 USC 1926b protection in the annexed area.
2. Water for fire protection to serve the substantially developed annexed area(s) will be provided in accordance with current policies of Morristown Utility Commission unless authorized by franchise agreement with another utility district which has made service available with capability to meet City of Morristown Fire Protection Standards. Any extension of water system infrastructure beyond that of the Morristown Utility Commission policies shall be at the expense of the property owner or developer.
3. In those parts of the annexed area that are currently served by another utility district, the above conditions and terms will begin upon acquisition of service area by Morristown Utility System or approval of franchise agreement with another utility district which may be delayed by negotiation and/or litigation.
d. Sewers
The necessary collecting, intercepting and trunk sewers to serve the substantially developed annexed area(s) shall be in accordance with the current policies of the city. Any extension of said sewers beyond that of the city’s policies shall be at the expense of the property owner or property developer.
e. Electrical
1. Electrical service for domestic, commercial and industrial use will be provided at city rates for new lines as extended in accordance with current policies of Morristown Utility Commission.
2. In those parts of the annexed area presently served by another utility cooperative, the above conditions or terms will begin with the acquisition by the city of such cooperatives or parts thereof, which may be delayed by negotiations and/or litigation.
f. Refuse Collection
The property owner/property developer shall be responsible for refuse collection.
g. Streets
The property owner/property developer shall be responsible for construction of streets, routine maintenance, reconstruction and resurfacing of streets, installation of storm drainage facilities, construction of curbs and gutters and other such major improvements.
h. Inspection Services
Any inspection services now provided by the city (building, electrical, plumbing, gas, housing, weights and measures, sanitation, etc.) will begin upon the effective date of annexation.
i. Planning and Zoning
The planning and zoning jurisdiction of the city will apply to the annexed area in conjunction with the effective date of annexation. The staff recommends a zoning classification of Planned Residential Development District (RP-1) to the designated annexation area.
j. Street Lighting
The property owner/property developer shall be responsible for the installation of streetlights.
k. Recreation
Residents of the annexed area may use all existing recreational facilities, parks, etc., on the effective date of annexation. The same standards and policies now used in the present city will be followed in expanding the recreational program and facilities in the enlarged city.
l. Miscellaneous
Street name signs where needed will be installed as new street construction requires.
Section II. This Resolution shall become effective from and after its adoption.

A public hearing was held on the following captioned Ordinance No. 3240. Councilmember Jinks made a motion to adopt the Ordinance No. 3240 on second and final reading. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.
Ordinance No. 3240
Entitled an Ordinance to annex and designate the zoning classification of certain territory and to incorporate same within the corporate boundaries of the City of Morristown, Tennessee. {Annexation of a 55-acre lakeside portion adjacent to the Windswept Development with the Zoning Classification of Planned Residential Development District (RP-1).}
A public hearing was held on the following Resolution No. 03-06. Councilmember McGuffin made a motion to adopt said Resolution. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

PLAN OF SERVICES
A RESOLUTION ADOPTING A PLAN OF SERVICES FOR THE ANNEXATION OF PROPERTY KNOWN AS THE DRINNON PROPERTY LOCATED AT 855 THOMPSON CREEK ROAD.
WHEREAS, TENNESSEE CODE ANNOTATED, TITLE 6, CHAPTER 51, AS AMENDED REQUIRES THAT A PLAN OF SERVICES BE ADOPTED BY THE GOVERNING BODY.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF MAYOR AND COUNCIL OF THE CITY OF MORRISTOWN, TENNESSEE:
Beginning at the point of intersection of Parcels 22.00, 22.02, and 23.00 of Hamblen County Tax Map 34 and continuing in a northerly direction along the common boundary shared by Parcels 22.00 and 22.02 of Hamblen County Tax Map 34 to the most north eastern corner of Parcel 22.02 of Hamblen County Tax Map 34; thence in a westerly direction to the point of intersection of Parcels 22.00 and 22.02 with the centerline of Thompson Creek Road; thence in a southerly direction along the centerline of Thompson Creek Road to the point of intersection of Parcels 22.02, 23.00 of Hamblen County Tax Map 34 and the centerline of Thompson Creek Road; thence in a westerly direction following the common boundary line shared by Parcels 22.02 and 23.00 of Hamblen County Tax Map 34 to the point of beginning.

Sewer will not be extended to the existing residences for at least ten (10) years after annexation. However, if the planned commercial shopping center proceeds with development prior to this, the city will provide sewer at developer’s expense at that time.

2. Reconstruction and resurfacing of streets, installation of storm drainage facilities, construction of curbs and gutters, and other such major improvements, as the need therefore is determined by the governing body, will be accomplished under current policies of the city.
h. Inspection Services
Any inspection services now provided by the city (building, electrical, plumbing, gas, housing, weights and measures, sanitation, etc.) will begin upon the effective date of annexation.
i. Planning and Zoning
The planning and zoning jurisdiction of the city will apply to the annexed area in conjunction with the effective date of annexation. The staff recommends a zoning classification of Planned Commercial Development (PCD) to the designated annexation area.
j. Street Lighting
Street lights will be installed under the standards currently prevailing in the existing city.
k. Recreation
Residents of the annexed area may use all existing recreational facilities, parks, etc., on the effective date of annexation. The same standards and policies now used in the present city will be followed in expanding the recreational program and facilities in the enlarged city.

Street name signs where needed will be installed as new street construction requires.

A public hearing was held on the following captioned Ordinance No. 3241. Councilmember McGuffin made a motion to adopt the Ordinance No. 3241 on second and final reading. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Councilmember Senter made a motion to approve the contract with Interior Design - Commercial Environments, Inc. in the amount of $50,743.27 for renovations to the Planning Department office area. Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'.
Councilmember Jinks made a motion to award the bid for the Traffic Crash Team Total Pulse Station to ASC, Inc. in the amount of $25,225 for two stations. Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'.
Councilmember Jinks made a motion to approve the contribution of $250,000 in matching state grant funds for the Colgate Palmolive pilings. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.
Councilmember McGuffin requested that a hearing on usage of the soccer fields be added to the agenda. There were no objections and the item was added.
Councilmember McGuffin made a motion to allow the high schools the usage of the fields for this year only. Councilmember Jinks seconded the motion.
Councilmember McGuffin amended his motion to: To allow both high school soccer teams to utilize the facilities at Frank Lorino or anywhere else within the City of Morristown that are City-owned parks. Councilmember Jinks seconded the amended motion. Councilmember Rooney voted “no” (“until after the meeting tomorrow, I vote no”); all others voted 'aye'.
Councilmember Senter represented the City at the 190th Engineer Co. Freedom Salute Honors Ceremony on March 5th and accepted a plaque in recognition of the City Council’s support of the troops and their families during the Operation Iraqi Freedom and accepted the flag that the soldiers took with them to Iraq which has been touched by each member of the 190th and they wanted to return it to the Mayor to be housed at City Center. Councilmember Senter presented the items to Mayor Johnson. The mementos will be placed in a display case at City Center.
Mayor Johnson adjourned the March 7, 2006 meeting.
