CORPORATION OF MORRISTOWN
MAY 2, 2006
The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, May 2, 2006 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: Claude Jinks, Frank McGuffin, William Rooney, Kay Senter, Rick Trent and Mel Tucker.
Councilmember Jinks made a motion to approve the April 18, 2006 minutes as circulated; Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.
Mayor Johnson announced that the run-off election for the employees’ representative on the Civil Service Board would be held on May 24, 2006.
Administrator Crumley read a Proclamation designating May as 'Neurofibromatosis Awareness Month'.
Mayor Johnson recognized four students doing internships at the City: Sammy Parcell, Mike Fielden, Brandon Hudson and Adam Elder.
A public hearing was held on the following captioned Ordinance No. 3244. Councilmember Senter made a motion to adopt said Ordinance on second and final reading. Councilmember Trent seconded the motion and upon roll call, all voted 'aye'.
Ordinance No. 3244
Entitled an Ordinance to amend Title 14 of the Morristown Municipal Code by deleting the current Chapter 22-Flood Damage Prevention of the Zoning Ordinance and creating a new Chapter 22-Municipal Floodplain Zoning Ordinance.
Councilmember Senter made a motion to award the bid for the Colgate-Palmolive caisson installation to the Long Foundation Drilling Co. in the amount of $1,291,618 subject to two qualifications – 1) approval by the Department of Economic and Community Development and 2) that Colgate-Palmolive sign and return the reimbursement agreement. {Colgate will reimburse the City for expenditures beyond $500,000 ($250,000 City funds and $250,000 State funds).} Councilmember Trent seconded the motion and upon roll call, all voted 'aye'.
Councilmember Senter made a motion to adopt the following Resolution No. 06-06; Councilmember Jinks seconded the motion and upon roll call, all voted 'aye'.
RESOLUTION NO. 06-06
A Resolution designating Tuesday, May 9, 2006 as 'National Teacher Day'.
WHEREAS, it is fitting that the City of Morristown designate May 9, 2006 as 'National Teacher Day' in recognition of our teachers and of the fact that they are one of our more important resources for building the future; and
WHEREAS, teachers in this country do more than teach our children to read and write; they also impart to our children the essence of our culture, our ethics and our conscience; and
WHEREAS, teachers open children’s minds to the magic of ideas, knowledge and dreams; and
WHEREAS, teachers keep American democracy alive by laying the foundation for good citizenship; and
WHEREAS, teachers fill many roles, serving as listeners, explorers, role models, motivators and mentors; and
WHEREAS, teachers continue to influence us long after our school days are only memories.
NOW, THEREFORE, be it resolved that the Mayor and City Council of the City of Morristown concur with the State of Tennessee in designating Tuesday, May 9, 2006 as “National Teacher Day” for the purpose of providing public recognition and appreciation for our teachers’ dedication to their profession and their many contributions to the our children.

Councilmember Tucker made a motion to adopt the following captioned Ordinance No. 3245 on first reading and schedule a public hearing relative to final passage of said Ordinance for May 16, 2006. Councilmember McGuffin seconded the motion and upon roll call, Councilmembers Jinks, McGuffin, Senter, Trent, Tucker and Mayor Johnson voted 'aye'; Councilmember Rooney voted “no”.
Ordinance No. 3245
Entitled an Ordinance to close and vacate certain rights-of-way within the City of Morristown. [Right-of-way closure – Hill Street from the intersection of East First North to East Second North Streets.]
Councilmember McGuffin made a motion to adopt the following captioned Ordinance No. 3246 on first reading and schedule a public hearing relative to final passage of said Ordinance for May 16, 2006. Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'.

Entitled an Ordinance to annex certain territory and to incorporate same within the corporate boundaries of the City of Morristown, Tennessee. [Annexation and High Density Residential (R-3) Zoning Classification of the property located along Valley Home Road (Parcel 52, Tax Map 41).]
Councilmember Jinks made a motion to adopt the following captioned Ordinance No. 3247 on first reading and schedule a public hearing relative to final passage of said Ordinance for May 16, 2006. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.
Ordinance No. 3247
Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Appendix B. [Rezoning of property along East Morris Boulevard and on both sides of Daisy Street, (Parcel 23, Group D, Tax Map 34-I and Parcel 12, Group E, Tax Map 34-I), from Light Industrial (LI) to Central Business District (CBD).
Councilmember Tucker made a motion to adopt the following captioned Ordinance No. 3248 on first reading; Councilmember Jinks seconded the motion and upon roll call, all voted 'aye'.
Ordinance No. 3248
Being an Ordinance of the City Council for the City of Morristown, Tennessee adopting and implementing an ethics policy for the City.
Councilmember Jinks made a motion to reappoint Michael Price, Eddie Fuller and Max Cook to the Construction Board of Adjustments, Appeals and Examiners for three year terms to expire May 1, 2009; Councilmember Rooney seconded the motion. Councilmember Rooney made a motion that nominations cease and they be elected by acclamation; all voted 'aye'.
Mayor Johnson adjourned the May 2, 2006 meeting.
