APRIL 5, 2005

The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, April 5, 2005 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: Claude Jinks, William Rooney, Kay Senter, William Thompson and Rick Trent. Absent: Frank McGuffin.

Councilmember Jinks made a motion to approve the March 22, 2005 minutes as circulated; Councilmember Thompson seconded the motion and upon roll call, all voted 'aye'.

Councilmember Jinks made a motion to approve the March 29, 2005 Beer Board minutes as circulated; Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

A public hearing was conducted on the following captioned Ordinance No. 3211. Councilmember Senter requested that the Ordinance be revised by substituting the word “and” for the word “or” in Section 1-102, 1 thru 4. Councilmember Rooney made a motion to adopt the revised Ordinance No. 3211 on second and final reading. Councilmember Thompson seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3211
Entitled an Ordinance to amend Title 1, Chapter 1 – Municipal Wards of the Morristown Municipal Code.

A public hearing was conducted on the following captioned Ordinance No. 3212. Councilmember Thompson made a motion to adopt Ordinance No. 3212 on second and final reading; Councilmember Trent seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3212 Entitled an Ordinance to amend Section 14-8B02 – Uses Permitted and Section 14-8B03 – Uses Permitted on Review, Chapter 8B (Zoning Ordinance) of Title 14 of the Morristown Municipal Code by deleting the sections in their entirety and substituting new sections therefor.

A public hearing was conducted on the following captioned Ordinance No. 3213. Councilmember Thompson made a motion to adopt Ordinance No. 3213 on second and final reading; Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3213 Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Tennessee, Appendix B. {Rezoning of property at 510 and 518 West 3rd North Street from Medium Density Residential (R-2) to Office, Medical and Professional (OMP).}

A public hearing was conducted on the following captioned Ordinance No. 3214. Councilmember Rooney made a motion to adopt Ordinance No. 3214 on second and final reading; Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3214 Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Tennessee, Appendix B. {Rezoning of property on Country Club Drive from Single Family Residential (R-1) to Office, Medical and Professional (OMP).}

Councilmember Thompson made a motion to approve a contract with the Charlie Daniels Band for a Sesquicentennial Performance on May 30, 2005 at the Cherokee Park Amphitheatre. Councilmember Senter seconded the motion; and upon roll call, all voted 'aye'.

The contract with Dollywood for the City Employees Picnic was postponed until the April 19, 2005 Council meeting.

Councilmember Rooney made a motion to approve the Architectural Contract for Fire Station # 6 to James Edward Fuller Architects in the amount of $27,957.12. Councilmember Jinks seconded the motion and upon roll call, all voted 'aye'.

Councilmember Thompson made a motion to adopt the following Resolution No. 9-05; Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'

Homeland Security Policy

Resolution No. 9-05
A Resolution to adopt the National Incident Management System as required by the Department of Homeland Security, Office of Domestic Preparedness.

This policy is made and entered into on the 5th day of April 2005 by the Morristown City Council, hereinafter referred to as the 'Council' and is intended to be binding on all the emergency services and response agencies of the City of Morristown.

WHEREAS, on December 17, 2004 the President of the United States signed into law the Intelligence Reform Act of 2004, hereinafter referred to as 'the Act', which contained several recommendations for the minimum training requirements of all first responders; and

WHEREAS, 'the Act' formally created the National Incident Management System (NIMS) and recognized it as the cornerstone of unified command training for all emergency personnel in the United States; and

WHEREAS, the Secretary of Homeland Security has created a timeline for nationwide adoption of NIMS; and

WHEREAS, the Department of Homeland Security, through the Office of Domestic Preparedness, has made NIMS compliance a requirement for the application of any federal homeland security funds; and

WHEREAS, the City of Morristown wishes to comply with the federal Homeland Security Strategy; and

WHEREAS, this system will provide a consistent nationwide approach for federal, state, local, and tribal governments to work effectively and efficiently together to prepare for, prevent, respond to, and recover from domestic incidents, regardless of cause, size, or complexity;

NOW, THEREFORE, BE IT RESOLVED that the Morristown City Council hereby adopts the National Incident Management System and requests the Director of the Morristown-Hamblen Emergency Management Agency send a copy of this resolution to the Tennessee Emergency Management Agency in order to show proof of compliance.

IN WITNESS WHEREOF, the Morristown City Council has issued this policy on the 5th day of April 2005.

Resolution No. 10-05 relative to support of the Crockett Parkway Interchange was amended as follows: 1) changed “interstate highway” to “controlled access corridor”; 2) to involve the affected citizens/businesses in the process of developing alternate designs for the project; and 3) added a paragraph stating that the interchange was initially proposed during the corridor hearings of the Appalachian Regional Commission and has been discussed for a period of at least thirty years.

Councilmember Thompson made a motion to adopt the following Resolution No. 10-05 as amended; Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Resolution No. 10-05
A Resolution in Support of the Crockett Parkway Interchange.

The City of Morristown, in conjunction with the Tennessee Department of Transportation, the Appalachian Regional Commission, State Senator Steve Southerland and State Representative John Litz, has successfully promoted the concept of US-25E (Crockett Parkway) transforming to a controlled access corridor standard in Morristown; and

Whereas, the interchange was initially proposed during the corridor hearings of the Appalachian Regional Commission and has been discussed for a period of at least thirty years; and

Whereas, Senator Southerland and Representative Litz secured funding for an interchange and frontage road system in the area of State Route 343 in the Witt Community in the 2003-2004 State Budget; and

Whereas, a number of local citizens spoke out about the only version of the proposed interchange offered for comment by the Tennessee Department of Transportation; and

Whereas, Morristown City staff are aware of a number of alternative designs for the proposed interchange that were not offered for review or comment by the citizens at the initial 'roll out' of plans for the project.

Now, therefore, The Mayor and the City Council of Morristown respectfully request that Senator Southerland and Representative Litz continue to pursue the concept of transforming Crockett Parkway into a controlled access corridor standard for its entire length through the City of Morristown; and

To involve the Tennessee Department of Transportation and the affected residents in refining and developing alternate designs for the interchange and frontage road system to lessen the impact on local businesses and residents.

Councilmember Rooney made a motion to adopt the following captioned Ordinance No. 3215 on first reading and schedule a public hearing relative to final passage of said Ordinance for April 19, 2005. Councilmember Thompson seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3215
Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Tennessee, Appendix B. {Rezoning of property on East Andrew Johnson Highway at North Liberty Hill Road from Medium Density Residential (R-2) to Intermediate Business (IB).}

Councilmember Jinks made a motion to cancel the May 3, 2005 City Council meeting due to May 3rd being the date of the 2005 City Election. Councilmember Thompson seconded the motion and all voted 'aye'.

Councilmember Jinks made a motion to declare the light fixtures and poles from Sherwood Park as surplus property. Councilmember Thompson seconded the motion and all voted 'aye'.

Councilmember Jinks made a motion to donate the light fixtures and poles from Sherwood Park to the West High Ladies Softball Program. Councilmember Thompson seconded the motion and all voted 'aye'. {Attorney Jessee will prepare a contract releasing the City from any liability in the donation of said property.}

Mayor Johnson adjourned the April 5, 2005 City Council Meeting.
