AUGUST 16, 2005

The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, August 16, 2005 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: Claude Jinks, Frank McGuffin, William Rooney, Kay Senter, Rick Trent and Mel Tucker.

Councilmember Jinks made a motion to adopt the August 2, 2005 minutes as circulated; Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Communications from the Mayor

1) Mayor Johnson announced that he had not completed his selection of the committee to look into the Beer Ordinance. The announcement will be delayed until the full committee has been selected.

2) Chief Overholt gave an analysis report on the costs of City police officers currently assigned to the school system. The School Resource and DARE Officers’ salaries & benefits are $203,896.61 per year. The officers are assigned to the schools approximately nine months out of the year at a cost of $152,922.60.

A public hearing was held on Plans of Service and Progress Reports for eighteen annexations – Ordinance Numbers, 3110, 3111, 3125, 3126, 3133, 3134, 3174, 3183, 3184, 3185, 3186, 3187, 3195, 3201, 3207, 3208, 3216 and 3217.

Councilmember Senter made a motion to award the contract for subsurface exploration for the Communications Tower site to Foundation Systems Engineering Co. in the amount of $6,350. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Councilmember Rooney made a motion to approve Change Order #1 to Portland Utilities for the Fish Hatchery Road Sewer Extension in the amount of $88,825.60. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember McGuffin made a motion to approve the following captioned Ordinance No. 3228 on first reading and schedule a public hearing relative to final passage of said Ordinance for September 6, 2005. Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'. Ordinance No. 3228

Entitled an Ordinance to annex and designate the zoning classification of certain territory and to incorporate same within the corporate boundaries of the City of Morristown, Tennessee. {Annexation and zoning classification as R-1 (Single Family Residential) of the property located at the corner of Dearing Road and Highway 160.}

Councilmember Tucker made a motion to approve the following captioned Ordinance No. 3229 on first reading and schedule a public hearing relative to final passage of said Ordinance for September 6, 2005. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Councilmember Rooney made a motion to approve the following captioned Ordinance No. 3230 on first reading and schedule a public hearing relative to final passage of said Ordinance for September 6, 2005. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember McGuffin made a motion to approve the following captioned Ordinance No. 3231 on first reading and schedule a public hearing relative to final passage of said Ordinance for September 6, 2005. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Tennessee, Appendix B. {Rezoning of property at 5141 and 5139 Old Highway 11-E from R-1 (Single Family Residential) to IB (Intermediate Business).} Councilmember Jinks made a motion to approve the following captioned Ordinance No. 3232 on first reading and schedule a public hearing relative to final passage of said Ordinance for September 6, 2005. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Tennessee, Appendix B. {Rezoning of property at 1332 Shields Ferry Road from IB (Intermediate Business) to LI (Light Industrial).}

Councilmember Jinks made a motion to reappoint Bryan Dickerson to the Housing Board of Adjustments and Appeals for a three year term to expire on August 15, 2008. Councilmember McGuffin seconded the motion. Councilmember Senter made a motion that nominations cease and Mr. Dickerson be elected by acclamation; Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember Jinks made a motion to accept Chief Honeycutt’s recommendation and promote Thomas Evans to Fire Driver/Engineer. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember Jinks made a motion to accept Chief Overholt’s recommendation and hire Kenneth Davis as an entry-level police officer. Councilmember Trent seconded the motion and all voted 'aye'.

Councilmember Jinks made a motion to accept Chief Overholt’s recommendation and hire Gregory Hall as an entry-level police officer. Councilmember Rooney seconded the motion and all voted 'aye'.

Councilmember Jinks made a motion to accept Chief Overholt’s recommendation and hire Devin Cribley as an entry-level police officer. Councilmember McGuffin seconded the motion and all voted 'aye'.

Councilmember Jinks made a motion to accept Chief Overholt’s recommendation and hire Dustin Jones as an entry-level police officer. Councilmember Rooney seconded the motion and all voted 'aye'.

Mayor Johnson adjourned the August 16, 2005 City Council Meeting.
