JANUARY 3, 2006

The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, January 3, 2006 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: Claude Jinks, Frank McGuffin, William Rooney, Kay Senter, Rick Trent and Mel Tucker.

Councilmember Jinks made a motion to adopt the December 20, 2005 minutes as circulated; Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'.

Krisna Goodwin presented City Council with a Key to the City from the City of Morristown, Minnesota in honor of our shared sesquicentennial.

A public hearing was conducted on the following captioned Ordinance No. 3239. Councilmember Jinks made a motion to adopt said Ordinance on second and final reading. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3239
Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Tennessee, Appendix B. {Rezoning of a portion of the property being developed by Southridge Development LP at the intersection of Dearing Road and State Route 160 (Air Park Blvd.) from Single Family Residential (R-1) to Mixed Use Development (MUD) for Phase II.}

Councilmember Trent made a motion to award the Railroad Relocation Feasibility Study to Tysinger, Hampton & Partners in the amount of $30,000; Councilmember Senter seconded the motion. Councilmembers Trent and Senter withdrew their motion and second. Councilmember Senter made a motion to postpone action on the contract until after the City Council Retreat. Councilmember Jinks seconded the motion and all voted 'aye'.

Councilmember Rooney made a motion to award the contract for planning and engineering services for the industrial access road to Jeffrey-Renold (Veterans Parkway) to Hodge Engineering in the amount of $91,383.28; Councilmember Senter seconded the motion and upon roll call all voted 'aye'.

Councilmember Senter made a motion to award the contract for planning and engineering services for the industrial access road from Merchants Greene to Lot 44, M.A.I.D. to Campbell Associates in an amount not to exceed $250,000; Councilmember Rooney seconded the motion. Upon roll call, Councilmember Trent voted 'no' and all others voted 'aye'.

Councilmember Tucker made a motion to award the contract for the development of a master plan for the Morristown College Neighborhood Revitalization Project (MCNRP) to Barge, Waggoner, Sumner & Cannon in the amount of $81,000. Councilmember Rooney seconded the motion and upon roll call, Councilmember Trent voted “no” and all others voted 'aye'.

Councilmember Jinks made a motion to award the Parks & Recreation Beverage Contract to Morristown Coca Cola in the amount of $88,000 for a seven year period. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

The Spout Springs Road sewer extension bid was postponed until a later date.

Mayor Johnson reappointed Vice-Mayor Senter and Councilmembers Jinks and McGuffin as the 2006 Finance Committee. Councilmember Jinks made a motion to accept Chief Overholt’s recommendation and hire David Klein as an entry-level police officer. Councilmember Tucker seconded the motion and all voted 'aye'.

Without objection from City Council an item was added to the agenda – purchase of property in ETPC. Councilmember Jinks made a motion to approve a contract to purchase 8.1 acres of property in the East Tennessee Progress Center from Flossie Howard in the amount of $110,000. Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'.

CITY COUNCIL CONVENED AS THE BEER BOARD.

Chief Overholt and Captain Lowe reported on problems with the Metro Grill, 709 South Cumberland Street. Between December 18, 2004 and December 18, 2005, the police were called to the establishment 113 times; there were four additional calls this past weekend, two of which were for assaults. Also, an employee of the establishment was cited in December for selling beer between the hours of 12:00 a.m. and 8:00 a.m. and for not having a server permit.

Chief Overholt requested that a Show Cause Hearing be scheduled.

After confirmation that the Metro Grill had been warned by the Police Department about the need to assume some responsibility for the activities on their property, Councilmember Tucker made a motion to suspend the Metro’s beer license; Councilmember Jinks seconded the motion. City Attorney Jessee informed Council that the law requires notice to the owners to appear before the Beer Board for a show cause hearing.

Councilmembers Tucker and Jinks withdrew their motion and second to suspend the license. Councilmember Tucker made a motion to serve notice to the Metro Grill to appear before the Beer Board for a Show Cause Hearing. Councilmember Jinks seconded the motion and upon roll call, all voted 'aye'. The Show Cause hearing was scheduled for the January 17, 2006 City Council meeting.
Mayor Johnson adjourned the January 3, 2006 meeting.
