July 5, 2005

The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, July 5, 2005 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: William Rooney, Kay Senter, Rick Trent and Mel Tucker; and the following named Councilmembers absent: Claude Jinks and Frank McGuffin.

Councilmember Rooney made a motion to adopt the June 21, 2005 and June 28, 2005 minutes as circulated; Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'.

Mayor Johnson presented retirement watches and proclamations to Bill Thompson, Planner and Raymond Wolfe, Building Inspector.

Councilmember Senter made a motion to approve a contract with Lamar Dunn & Associates in the amount of $11,000 to perform an update (mid-course correction) on the ten year sewer financial plan. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Councilmember Senter made a motion to approve a contract with Hodge Engineering for Resident Project Representation for the North Liberty Hill Road Sanitary Sewer Extension in an amount not to exceed $90,000. Councilmember Tucker seconded the motion and upon roll call, all voted 'aye'.

Councilmember Rooney made a motion to award the bid for the East First North Reconstruction Project to G.W. Wyatt Contracting in the amount of $3,735,458.85. Councilmember Senter seconded the motion and upon roll call, all voted “aye”. {Councilmember Senter asked that the City Council minutes be researched for comments made by a representative from APAC regarding the previous paving of East First North Street.)

Councilmember Tucker made a motion to award the contract for additional engineering services for the construction phase of Dr. Martin Luther King, Jr. Park to McGill Associates in the amount of $34,900. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Councilmember Trent made a motion to award the contract for the Airport Security Fencing to Rio Grande Fencing in the amount of $47,157. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

The contract to replace the Communications Tower on 7th North Street was deferred until the July 19, 2005 Council meeting.

Councilmember Tucker made a motion to approve Supplemental Agreement #1 to Wilbur Smith Associates in the amount of $16,400 for engineering services on Pearce Drive. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember Rooney made a motion to approve Contract Amendment #1 to McGill Associates in the amount of $6,187.40 for Phase 1 – Turkey Creek Greenway engineering contract. Councilmember Senter seconded the motion and upon roll, all voted 'aye'.

Councilmember Senter made a motion to approve Change Order #1 to Southern Constructors in the amount of $113,959 for the West 1st North Turkey Creek Bridge Replacement Project. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

With no objection from Council, the award of the bid for the North Liberty Hill Road Sanitary Sewer Extension Project – Phase I was added to the agenda.

Councilmember Rooney made a motion to award the bid for the North Liberty Hill Road Sanitary Sewer Extension Project – Phase I to Merkel Brothers Construction Company in the amount of $275,401. Councilmember Trent seconded the motion and upon roll call, all voted 'aye'.

Councilmember Tucker made a motion to adopt the following captioned Ordinance No. 3222 on first reading; Councilmember Senter seconded the motion. Councilmember Trent made a motion to table Councilmember Tucker’s motion and send the Ordinance back to the Planning Staff; Councilmember Rooney seconded the motion and all voted 'aye'.

Ordinance No. 3222 Entitled an Ordinance to amend Title 16 of the Morristown Municipal Code by adding a new Chapter 5 – Security Gates; and to amend Title 16, Chapter 1, Section 16-104, by deleting Section 16-104 in its entirety and substituting a new section 16-104.

Councilmember Tucker made a motion to adopt the following captioned Ordinance No. 3223 on first reading and schedule a public hearing relative to final passage of said Ordinance for July 19, 2005. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Entitled an Ordinance to amend the Morristown Municipal Code, Title 14, Chapter 2 (Zoning Ordinance), Section 14-215, Subsection 1 – Mobile Homes on Individual Lots, by deleting Subsection 1 in its entirety and substituting a new Subsection 1 therefor.

Councilmember Tucker made a motion to adopt the following captioned Ordinance No. 3224 on first reading and schedule a public hearing relative to final passage of said Ordinance for July 19, 2005. Councilmember Trent seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3224
Entitled an Ordinance to amend the Municipal Code of the City of Morristown, Tennessee, Appendix B. {Rezoning of property on Murrell Road from Single Family Residential (R-1) to Moderate Density Single Family Residential (RD-1)}.

The authorization to purchase property for Fire Station # 6 was deferred since the appraisal was not ready.

Mayor Johnson adjourned the July 5, 2005 City Council Meeting.
