JUNE 1, 2004

The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, June 1, 2004 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: Claude Jinks, Frank McGuffin, William Rooney, Kay Senter and Rick Trent; absent: Councilmember William Thompson.

Councilmember Jinks made a motion to approve the May 18, 2004 minutes as circulated; Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Councilmember Senter made a motion to adopt the following Resolution No. 14-04. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Resolution No. 14-04
A Resolution Setting the Employer Contribution Rate to the Tennessee Consolidated Retirement System at 7.37% for Fiscal Years 2005 and 2006.

WHEREAS, the City of Morristown is a member of the Tennessee Consolidated Retirement System; and

WHEREAS, the Tennessee Consolidated Retirement System’s recommended employer contribution rate is currently 7.37%.

NOW, THEREFORE, BE IT RESOLVED, that the City of Morristown hereby sets the employer contribution rate to the Tennessee Consolidated Retirement System at 7.37% for Fiscal Years 2005 and 2006.

ADOPTED this 1st day of June 2004.

Councilmember Jinks made a motion to adopt the following captioned Ordinance No. 3178 on first reading. Councilmember Trent seconded the motion and upon roll call, all voted 'aye'.

Ordinance No. 3178
Entitled an Ordinance to Amend Title 12, Chapter 3 of the Morristown Municipal Code. (Adoption of the 2002 Edition of the National Electrical Code and Certain Amendments Thereto; and to Amend Certain Portions of Title 12, Chapter 3 which are in conflict with Title 12, Chapter 1 and Title 9, Chapter 10.)

Councilmember Jinks nominated Arnold Bunch, Walter Dockery and Clifton Jackson for appointment to the Morristown Parks & Recreation Advisory Board. (Three year appointments to expire 6/1/07.) Councilmember Rooney made a motion that nominations cease and they be elected by acclamation. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Councilmember Jinks made a motion to approve an Interlocal Cooperation Agreement among the Hamblen County Emergency Communications District, Hamblen County and the City of Morristown. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember Senter made a motion to declare two (2) Street Hawk light bars as surplus property and authorize donation of the light bars to the Walters State Police Training Program. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Councilmember Rooney made a motion to approve the Hotel/Motel Tax Settlement Agreement with Hamblen County (Holiday Inn and Parkway Inn located @ Exit 8). Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember Jinks made a motion to deny the Beer Permit Application for Juan C. Gonzalez, El Jarocho Tienda Mexicana, 2131 West Andrew Johnson Highway. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

{Jack Kennerly, Assistant City Administrator, recommended that City Council not grant the permit since Mr. Gonzalez is not a U.S. citizen nor does he have a legal immigrant status.}

Mayor Johnson adjourned the June 1, 2004 City Council meeting.
