MARCH 22, 2005
The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, March 22, 2005 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: Claude Jinks, Frank McGuffin, William Rooney, Kay Senter, William Thompson and Rick Trent.
Councilmember Jinks made a motion to approve the March 1, 2005 minutes as circulated; Councilmember Rooney seconded the motion and all voted 'aye'.
A public hearing was held on the Community Development Block Grant 2005 Draft Action Plan. {Comments from Linda Dietrich, M.A.T.S. - Supports involvement of City with Continuum of Care.}
Councilmember Thompson made a motion to award the contract for the Collinson Ford Sewer Project Contractor Inspector to Vaughn & Melton in the amount of $49,280. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.
Councilmember Rooney made a motion to adopt the following Resolution No. 7-05; Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.
RESOLUTION NO. 7-05
A RESOLUTION TO PARTICIPATE IN
THE THREE-STAR PROGRAM.
WHEREAS, the Tennessee Department of Economic Development and Community Development is committed to assist the communities it serves in creating opportunities for sustained economic growth through the Three-Star Program; and
WHEREAS, participation in the Three-Star Program affords certified communities the opportunity to develop and implement programs affecting the economic appeal and viability considered by business and industry in making investment decisions; and
WHEREAS, certification as a Three-Star community in the Three-Star Program involves cooperative effort by numerous local entities; and
WHEREAS, James H. Crumley, City Administrator, is the designated contact for the Three-Star Program.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the City of Morristown, Tennessee, in regular session on this 22nd of March 2005 that the City of Morristown will participate in the Three-Star Program.

Councilmember Senter made a motion to adopt the following Resolution No. 8-05; Councilmember Thompson seconded the motion and upon roll call, all voted 'aye'
Resolution Number 8-05
A Resolution Authorizing Application to the Tennessee Department of Agriculture, Forestry Division for the 2005 Urban Forestry Grant Assistance Program.
WHEREAS, the Morristown Tree Board of the City of Morristown serves as a committee to help make informed decisions about the preservation, landscaping, and planting of trees, and to educate the general public of Morristown; and
WHEREAS, the Morristown Tree Board recognizes the importance of trees in that they:
1. provide aesthetic quality
2. help clean the air
3. aid in storm water management
4. provide shade to keep energy costs down; and
WHEREAS, the City of Morristown has applied for previous urban forestry grants to meet goals and objectives recently, such as the Morristown Tree Canopy Study and creating the city’s first arboretum in Fred Miller Park; and
WHEREAS, the City of Morristown was recognized by the National Arbor Day Foundation for its accomplishments toward promoting the importance of trees in 2002, 2003 and 2004 by receiving the Tree City USA designation.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Morristown that:
Section I: The City of Morristown hereby authorizes the Mayor to submit an application to the Tennessee Department of Agriculture, Forestry Division to fund a portion of the Morristown Urban Forestry Program in 2005.
Section II: The application will seek grant funds and provide the required match in a total amount not to exceed $10,000.

Councilmember Thompson made a motion to adopt the following captioned Ordinance No. 3211 on first reading and schedule a public hearing relative to final passage of said Ordinance for April 5, 2005. Councilmember Jinks seconded the motion and upon roll call, all voted “aye”.

Councilmember Thompson made a motion to adopt the following captioned Ordinance No. 3212 on first reading and schedule a public hearing relative to final passage said Ordinance for April 5, 2005. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Entitled an Ordinance to amend Section 14-8B02 – Uses Permitted and Section 14-8B03 – Uses Permitted on Review, Chapter 8B (Zoning Ordinance) of Title 14 of the Morristown Municipal Code by deleting the sections in their entirety and substituting new sections therefor.
Councilmember Thompson made a motion to adopt the following captioned Ordinance No. 3213 on first reading and schedule a public hearing relative to final passage said Ordinance for April 5, 2005. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye.

Councilmember Thompson made a motion to adopt the following captioned Ordinance No. 3214 on first reading and schedule a public hearing relative to final passage said Ordinance for April 5, 2005. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Councilmember Jinks made a motion to adopt the following captioned Ordinance No. 3210 on second and final reading. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

An Ordinance granting a Franchise to the Morristown Utilities Commission, to build, construct, operate and maintain a cable television system in the City of Morristown, Tennessee, and setting forth conditions accompanying the granting of this Franchise.
Mayor Johnson re-appointed Sami Barile to the Morristown Regional Planning Commission for a four (4) year term to expire March 1, 2009.
Mayor Johnson adjourned the March 22, 2005 City Council Meeting.
