CORPORATION OF MORRISTOWN
May 17, 2005
The City Council for the City of Morristown, Hamblen County, Tennessee, met in regular session at the regular meeting place of the Council in the Morristown City Center at 4:00 p.m., Tuesday, May 17, 2005 with Honorable Mayor Gary R. Johnson presiding and the following named Councilmembers present: Claude Jinks, Frank McGuffin, William Rooney, Kay Senter, Rick Trent and Melvin Tucker.
Councilmember Jinks made a motion to approve the April 19, 2005; April 26, 2005; and May 9, 2005 minutes as circulated; Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.
Mayor Johnson presented retiring Councilmember William Thompson with a “Key to the City” plaque in recognition of his service on City Council and the Planning Commission. City staff presented him with mementos including his reserved parking sign, nameplate, pictures, plaques, caps, T-shirts, a certificate for a dogwood tree and a Sesquicentennial throw.
A public hearing was held on the Hamblen County 20-Year Growth Plan Amendment.
1) Mr. Larry Smith, South Ridge Development, spoke concerning a Planned Community Development (Cedar Ridge) on the property located on Highway 160 and Dearing Road. Encouraged City Council to adopt the Growth Plan Amendment.
2) Attorney Kelly Hinsley spoke for Mrs. Wonette Drinnon, the owner of 2.2 acres on Thompson Creek Road that were left out of the Urban Growth Boundary. Encouraged adoption of Growth Plan Amendment.
Councilmember Tucker made a motion to approve the Hamblen County 20-Year Growth Plan Amendment and return it to the Coordinating Committee. Councilmember Jinks seconded the motion and upon roll call, all voted “aye”.
Councilmember Rooney made a motion to award the bid for Phase I Rough Grading and Demolition for Dr. Martin Luther King, Jr. Park to Parkway Construction in the amount of $78,437; Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.
Councilmember Jinks made a motion to renew Ms. Evelyn Johnson’s Contract as Airport Manger for one year (6/1/05 -5/31/06). Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.
Councilmember Senter made a motion to award the bids for the Sherwood Park improvements: irrigation and sodding to Oakview Landscaping in the amount of $17,458; storm drainage materials from Sherman Dixie in the amount of $8,745.40; storm drainage materials from Walkers Supply in the amount of $947.12. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.
No bids were submitted on the Popkin Field storm drainage project.
Without objection from Council, a bid for a splashpad water park was added to the agenda.
Councilmember Tucker made a motion to award the bid for the “Splashpad” water park for Fred Miller Park to Howlett Equipment in the amount of $71,265; Councilmember Trent seconded the motion and upon roll call, all voted 'aye'.
Councilmember Rooney made a motion to adopt the following Resolution No. 13-05; Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.
RESOLUTION NO. 13-05
A RESOLUTION REQUESTING APPROVAL FROM THE STATE OF TENNESSEE TO MODIFY THE COMMUNITY DEVELOPMENT BLOCK GRANT POLICIES AND PROCEDURES RELATIVE TO INCOME ELIGIBILITY RESTRICTIONS.
WHEREAS, the City of Morristown has received a Community Development Block Grant for the rehabilitation of substandard dwellings in the Marsh Avenue neighborhood; and
WHEREAS, the City has established Policies and Procedures which govern the conduct of the project including income eligibility restrictions; and
WHEREAS, it has come to the attention of the City that there are unique and unusual circumstances which justify waiving certain of these rules on a case-by-case basis to attain the neighborhood stabilization and revitalization objectives of the project.
NOW, THEREFORE, BE IT RESOLVED by the Morristown City Council that the City requests approval from the State of Tennessee to modify said Policies and Procedures so that the income eligibility limits may be increased for households experiencing unusual and extreme financial hardships. Said income limits shall not be increased by more than five percent (5%) of the most recent limits set by HUD regarding low-and-moderate income households. Households requesting special consideration under the proposed rule shall provide clearly documented evidence that expenses constituting the hardship are clearly unique and unusual (e.g. extreme medical costs) and amount to not less than 25% of the household’s total annual income.

Councilmember Jinks made a motion to adopt the following captioned Ordinance No. 3216 on first reading and schedule a public hearing relative to the final passage of said Ordinance for June 7, 2005. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Councilmember McGuffin made a motion to adopt the following captioned Ordinance No. 3217 on first reading and schedule a public hearing relative to the final passage of said Ordinance for June 7, 2005. Councilmember Rooney seconded the motion and upon roll call, all voted 'aye'.

Councilmember Jinks made a motion to adopt the following captioned Ordinance No. 3218 on first reading with the public hearing and final reading to be determined. Councilmember McGuffin seconded the motion and upon roll call, all voted 'aye'.

Councilmember McGuffin made a motion to adopt the following captioned Ordinance No. 3220 on first reading and schedule a public hearing relative to the final passage of said Ordinance for June 7, 2005. Councilmember Senter seconded the motion and upon roll call, all voted 'aye'.

Councilmember Rooney nominated J.C. Wilson, Ed Sempkowski and Jerry T. Williams to the Parks & Recreation Advisory Board; Councilmember Jinks seconded and all voted 'aye'.
Councilmember Senter nominated Councilmember Mel Tucker to serve on the Ambulance Authority Board of Directors – EMS & Rescue Squad for tenure of office. Councilmember Rooney made a motion that nominations cease and Councilmember Tucker be elected by acclamation; all voted 'aye'.
Councilmember Jinks nominated William W. Thompson as the City representative on the Hamblen County Board of Equalization for a two year term to expire on May 1, 2007. Councilmember Rooney made a motion that nominations cease and Councilmember Tucker be elected by acclamation; all voted 'aye'.
Mayor Johnson adjourned the May 17, 2005 City Council Meeting.
